It raises the penalties for some of the most dangerous offenses and that are repeated the most on our roads and some changes in terms of mobility are also incorporated.

All the new fines that arrive

If we differentiate between the new sanctions that are included in the new Traffic Law, we can take into account those that exclusively affect drivers, those that try to protect vulnerable groups, such as cyclists, or those of New Creation to try to regulate the use of personal mobility vehicles.



One of the most controversial changes has been the elimination of the 20 km/h margin when overtaking on secondary roads. Until now, it was possible to exceed the maximum limit on this type of road, which has already been reduced to 90 km/h, to overtake another vehicle. This possibility disappears and all those who exceed the maximum limit will be sanctioned. One of the reasons that have been pointed out is that it will be easier for the DGT to install section radars on secondary roads.

In addition, with the ultimate goal of reducing speed on the road, he becomes punished have a radar detector in the car. Until now its use was only prevented but now it will be enough to have it installed in the vehicle. In this case, three points will be deducted from the driving license and a penalty will be 200 euro fine. The use or installation of radar inhibitors remains in the subtraction of six points of the card and up to 6,000 euros of fine, the worst case. Workshops that install these systems face penalties of up to 30,000 euros.

greater punishment

One of the great pursued by the DGT in recent years is the mobile phone. Until now, it was necessary to use it to be penalized with three points on the driver’s license and a 200-euro fine. With the latest changes, just hold it in your hand so that a traffic camera or an agent can register the action as a serious infraction. In addition, now the punishment is greater and will be sanctioned with six points less on the driving license, but the 200 euro fine remains.

The omission of the seat belt is also hardened. In 2020, 26% of those killed in road accidents he wasn’t wearing it. With the new wording of the law, they will detract four points of the license of driving instead of the three that were subtracted until now. The 200 euro penalty is maintained.

Protection for cyclists

Cyclists are one of the vulnerable groups that the DGT has wanted to protect the most with the drafting of the new update. In 2020, 71 cyclists died on the road and the figure, year after year, remains at similar figures since 2011.

One of the most important changes is the new fine for incorrectly overtaking cyclists. Now, not leaving a meter and a half of distance with the user of the bicycle will be punished with six points less on the driver’s license. In addition, it is specified that, if there are two or more lanes on the road, it will be mandatory to occupy the entire adjoining lane when overtaking. The economic fine is 200 euros, as it is considered a serious infraction.

In addition, the new wording also includes a fine of 200 euros for all those who stop or park in a bike lane or cycle path. In this way, the use of this means of transport is promoted and its users are protected, freeing up an exclusive space for its use and that of personal mobility vehicles.

Environmental Protection

In the reformed Traffic Law, there are two new sanctions with which it is intended to protect the environment. The first of them already existed as a very serious infraction (500 euros fine) and subtracts four points from the driving license. But now, throwing objects on the road or its surroundings that could cause fires or accidents will be punished with six points less on the card

The second one refers to the new Low Emission Zones that must be active in 2023 in all those cities with more than 50,000 inhabitants. Not respecting their restrictions or failing to comply with their anti-pollution protocols will entail a fine of 200 euros.

For the first time, personal mobility vehicles (VMP) have their space reserved in the Law on Traffic, Circulation of Motor Vehicles and Road Safety. It establishes that VMPs will have to wear a helmet “In the terms determined by regulation”. The same description used to define the mandatory use of helmets for cyclists. In addition, the express prohibition that personal mobility vehicles and cyclists cannot circulate on sidewalks, motorways and highways is added. Both avoiding the use of a helmet and riding on the sidewalk are serious offenses that are punishable by a 200-euro fine.

For the first time, the 0.0 rate is introduced in the Law on Traffic, Circulation of Motor Vehicles and Road Safety. At the moment, it is an exclusive obligation for minors who can move around on a moped, bicycle or personal mobility vehicle. Until now, this prohibition was not specified for minor users and non-compliance is a very serious offense so, if they do not have a driving license, the financial penalty is 500 euros.

Legal coverage is also given to the installation of systems that allow an anti-start breathalyzer to be incorporated in the future. A requirement that will be mandatory from July 5, 2022 for the homologation of new vehicles in Europe and whose use will come first for drivers of passenger transport in M2 and M3 vehicles, who will be obliged to use them from 6 of July.

How can points be recovered?

To recover the lost points, there is also a novelty that must be taken into account. If you have not received a sanction for two years for having committed an infraction that motivates the subtraction of points, you may recover the entire initial credit of the twelve points automatically. Thus, the exception by which it was necessary to wait three years for said recovery if a very serious infraction had been committed is eliminated.
